Who we are and how to contact us

TalentPointr Community is a site operated by Adgbenfash Consulting Limited.

By using TalentPointr Community you accept these terms

This acceptable use policy sets out the content standards that apply when you upload content to TalentPointr Community, make contact with other users on TalentPointr Community, link to TalentPointr Community, or interact with TalentPointr Community in any other way.

By using TalentPointr Community, you confirm that you accept the terms of this policy and that you agree to comply with them.

If you do not agree to these terms, you must not use TalentPointr Community.

We may make changes to the terms of this policy

We amend these terms from time to time. Every time you wish to use TalentPointr Community, please check these terms to ensure you understand the terms that apply at that time.

Prohibited uses

You may use TalentPointr Community only for lawful purposes.  You may not use TalentPointr Community:

  • In any way that breaches any applicable local, national or international law or regulation.
  • In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.
  • For the purpose of harming or attempting to harm minors in any way.
  • To bully, insult, intimidate or humiliate any person.
  • To send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards set out below.
  • To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
  • To transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

You also agree:

  • Not to reproduce, duplicate, copy or re-sell any part of TalentPointr Community in contravention of the provisions of our terms of use.
  • Not to access TalentPointr Community for the purposes of designing, developing, building, marketing or supporting a competitive product or service or design or support a product using similar ideas, functions or graphics.
  • Not to reverse engineer, disassemble or reverse compile TalentPointr Community;
  • Not to access without authority, interfere with, damage or disrupt any part of TalentPointr Community or any equipment or network or software owned or used by any third party.
  • Not to use TalentPointr Community for any purpose related to the harvesting or collecting of contact details of third parties by any means for the purposes of sending unsolicited emails or other communications.
  • Not to use automated scripts to collect information from or otherwise interact with TalentPointr Community.

Interactive services

We may from time to time provide interactive services on TalentPointr Community, including, without limitation, forums and comment boards.

We will do our best to assess any possible risks for users from third parties when they use any interactive service provided on TalentPointr Community, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on TalentPointr Community, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.

Where we do moderate an interactive service, we will normally provide you with a means of contacting the moderator, should a concern or difficulty arise.

Content standards

These content standards apply to any and all material which you contribute to TalentPointr Community (Contribution), and to any interactive services associated with it.

The Content Standards must be complied with in spirit as well as to the letter. The standards apply to each part of any Contribution as well as to its whole.

TalentPointr will determine, in its discretion, whether a Contribution breaches the Content Standards.

A Contribution must:

  • Be accurate (where it states facts).
  • Be genuinely held (where it states opinions).
  • Comply with the law applicable in Scotland and in any country from which it is posted.

A Contribution must not:

  • Be defamatory of any person.
  • Be obscene, offensive, menacing, hateful or inflammatory.
  • Bully, insult, intimidate or humiliate.
  • Promote sexually explicit material.
  • Include child sexual abuse material.
  • Promote violence.
  • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
  • Infringe any copyright, database right, trade mark or any other confidentiality rights of any other person.
  • Be likely to deceive any person.
  • Be likely to cause damage or injury to any person.
  • Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
  • Promote any illegal content or activity.
  • Be in contempt of court.
  • Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
  • Be likely to harass, upset, embarrass, alarm or annoy any other person.
  • Impersonate any person or misrepresent your identity or affiliation with any person.
  • Give the impression that the Contribution emanates from TalentPointr, if this is not the case.
  • Advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse.
  • Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.
  • Contain any advertising or promote any services or web links to other sites.

Breach of this policy

When we consider that a breach of this acceptable use policy has occurred, we may take such action as we deem appropriate. 

Failure to comply with this acceptable use policy constitutes a material breach of the terms of use upon which you are permitted to use TalentPointr Community, and may result in our taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use TalentPointr Community.
  • Immediate, temporary or permanent removal of any Contribution uploaded by you to TalentPointr Community.
  • Issue of a warning to you.
  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  • Further legal action against you.
  • Disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.

We exclude our liability for all action we may take in response to breaches of this acceptable use policy. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.

How this contract can be transferred

We can transfer our rights and obligations under these terms to any third party, provided this does not adversely affect your rights under these terms.

Which country’s laws apply to any disputes?

If you are a consumer, please note that the terms of this policy, its subject matter and its formation are governed by Scottish law. You and we both agree that the courts of Scotland will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of England and Wales, you may also bring proceedings in England and Wales.

If you are a business, the terms of this policy, its subject matter and its formation (and any non-contractual disputes or claims) are governed by Scottish law. We both agree to the exclusive jurisdiction of the courts of Scotland.

The TalentPointr is committed to preserving your privacy. This notice sets out how The TalentPointr (“we”, “our” and “us”) uses personal information that we collect from you when you use The TalentPointr Community.

For the purpose of the General Data Protection Regulation, the data controller is the Adgbenfash Consulting Limited.

This privacy notice applies to any registered or registering users of The TalentPointr Community.

This helps to enable connections and opportunities so that everyone can get the most out of The TalentPointr Community.

Equalities Information: Your gender, ethnicity and age

We collect this information as we wish to make sure The TalentPointr Community allows equal opportunities and to be able to assess and improve upon the accessibility of The TalentPointr Community

The TalentPointr Community is an interactive place which allows members to upload their own content and interact with other members. If you choose to upload any personal information this will be stored on The TalentPointr Community.

Consent – you are not obliged to contribute any personal information to the interactive areas of The TalentPointr Community and to do so will be at your own choosing.

Cookies Information: Information collected about you by way of cookies: this may include your IP address, browser type, and activity on The TalentPointr Community. For more details please see our Cookies Notice.

Retention of Your Information

We retain the personal data you provide while your account is in existence or as needed to provide you services. We will retain your information and keep your profile open until you or we decide to close your account.

We generally delete closed account information within 30 days of account closure, except as noted below.

We retain your personal data even after you have closed your account if reasonably necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, enforce our acceptable use policy and terms of use, or fulfil your request to opt out from further messages from us from The TalentPointr Community. As a Scottish Innovation Centre, we may have to comply with statutory retention periods as required by our funders.

Information regarding your interactions with others (e.g. through mail, uploaded videos or forum posts) will remain visible after you close your account or delete the information from your own profile or mailbox. We do not control data that other members may have copied out of our services.

Disclosure of Your Information

We will never sell or trade your personal information to others.

We use third party service providers and suppliers to deliver certain services. We put contractual arrangements in place with these third parties to ensure they are obliged to protect your personal information.

We only share your personal information where it is reasonably necessary to properly administer our business and/or to comply with law / regulations.

Please also note that other users of The TalentPointr Community will be able to view any personal information in your public profile or which you post to any interactive features on The TalentPointr Community.

Location of Your Information

The information we collect from you may be stored inside the UK, the European Economic Area (“EEA”) or outside the EEA.

If you live or work outside of the EEA, we may need to transfer your personal information outside of the EEA to correspond with you.  Where this applies, we will take all steps reasonably necessary to ensure that your personal information is treated securely and in accordance with this privacy notice.

We may transfer personal information outside the EEA where our service providers host, process, or store personal information outside the EEA.  Where this is the case we use contractual arrangements and safeguards to protect this personal information, these safeguards include:

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted online or through The TalentPointr Community. Any transmission is at your own risk. Once we have received your information, we use strict procedures and security features to try to prevent unauthorised access.
